The rules for using brance.ai

These Terms of Service ("Terms") are a contract between you and brance.ai ("we", "us") for use of the website and workspace. By creating an account or using the service you agree to these Terms and to our Privacy Policy.

If you use brance.ai on behalf of a company, you confirm you have authority to bind that company, and "you" includes that company.

1. The service

brance.ai is an agentic AI platform. You give a command. Specialist AI agents research, prospect, draft, send, follow up, support customers, keep records and report back through Mission Control. Features change as we ship. We do not guarantee any particular business result, lead volume, conversion rate or legal or tax outcome.

Some actions (for example sending outreach) may require your approval. You remain responsible for what is sent in your name, whether you approved it or enabled a more autonomous mode.

2. Accounts

You must provide accurate information, keep your password confidential and be at least 18. You are responsible for activity under your account. Tell us promptly if you think it has been compromised. We may refuse, suspend or close accounts that we reasonably believe violate these Terms or pose a risk to the service or to others.

3. Your content and our licence

You keep ownership of the content you and your agents create in the workspace (briefs, drafts, lists, files and similar). You grant us a worldwide, non-exclusive licence to host, process, transmit and display that content solely to provide, secure and improve the service, including sending it to AI and infrastructure providers as described in the Privacy Policy.

You confirm you have the rights to the content you upload and to instruct agents to process it.

4. AI output

Agent output can be wrong, incomplete, outdated or biased. It is not legal, tax, financial, medical or other professional advice. Roles such as Legal & Compliance, Finance Officer and People & HR are software assistants, not licensed professionals. You must review important output before you rely on it or send it to anyone.

To the extent allowed by law, you are responsible for how you use agent output. We do not claim copyright in model-generated text except as needed to operate the service.

5. Acceptable use

You agree not to use brance.ai to:

break the law, including spam, phishing, fraud, harassment or unauthorised access;
send marketing messages without a lawful basis and required notices in your jurisdiction;
scrape, probe or overload the service, or reverse engineer it except as allowed by law;
upload malware or attempt to extract another customer's data;
misrepresent that agent output is human-written where disclosure is required;
process special-category or highly sensitive personal data unless we have agreed in writing;
use the service to build a competing foundation model by systematically extracting outputs.

We may rate-limit, filter or block activity that looks abusive.

6. Third-party services

The product relies on third-party models, hosting, email and similar providers. Their terms also apply to the parts they provide. We are not responsible for outages or changes on those providers' side, though we will try to keep the workspace running.

7. Plans, usage and payment

Parts of brance.ai may be offered free, in beta or under usage caps. Paid plans, if introduced, will be described at signup or in the product. Fees are non-refundable except where the law requires. You are responsible for taxes. We may change prices with notice for the next billing period.

Usage that exceeds a cap may be slowed, queued or billed, as shown in the product.

8. Confidentiality

Each party will keep the other's non-public information confidential and use it only to perform under these Terms, except for information that is public, independently developed or required to be disclosed by law.

9. Suspension and termination

You may stop using brance.ai at any time. We may suspend or terminate access immediately if you breach these Terms, if we must do so by law, or if continuing would create security, legal or operational risk. We may also discontinue the service with reasonable notice where practical. After termination we may delete workspace data in line with the Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. We do not warrant that agents will be uninterrupted, error-free or available at any particular time.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, EVEN IF WE WERE ADVISED THEY WERE POSSIBLE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM, OR USD 100 IF YOU PAID NOTHING.

Some places do not allow these limits. In those places, our liability is limited to the minimum the law allows. Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud, where that cannot be limited.

12. Indemnity

You will defend and indemnify us against claims, damages and costs (including reasonable legal fees) arising from your content, your use of the service, your outreach and messages, or your breach of these Terms or applicable law.

13. Changes to the Terms

We may update these Terms as the product develops. We will change the "Last updated" date and, for material changes, give notice in the product or by email where appropriate. If you continue to use brance.ai after the change takes effect, you accept the new Terms. If you do not agree, stop using the service.

14. Governing law

These Terms are governed by the laws of Kenya, without regard to conflict-of-law rules. Courts located in Kenya have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction to protect our intellectual property or the service. If a court finds a clause unenforceable, the rest still applies.
